These terms constitute a legally binding agreement between you and Euphora Labs, TOO ("we", "us", "our"), operating as Nightmare.
By downloading, installing, or using Nightmare, you agree to these terms and our Privacy Policy. If you do not agree, do not use the app.
You must be 13 or older to use this app. If you are between 13 and 17, please review these terms with a parent or guardian. Some countries require a parent or guardian's permission for users under a certain age.
We may update these terms. Material changes will be reflected by an updated "Last Updated" date. Continued use after changes constitutes acceptance.
Nightmare is a subscription-based self-development app. Features include:
Chapters and reflection questions are generated by artificial intelligence (Anthropic Claude). AI output may contain inaccuracies, errors, or inappropriate content. You are solely responsible for any decisions or actions you take based on AI-generated content.
Nightmare is not therapy, medical advice, diagnosis, or mental health treatment. The AI is not a licensed professional. Do not use this app as a substitute for professional medical or psychological care. In a crisis, contact emergency services: 999 (UK), 988 (US), 112 (EU).
The website at nightmare.app is a free, publicly accessible informational site. Using it does not require an account, payment, or subscription.
The test at nightmare.app/test is a 20-question self-assessment based on the Big Five (OCEAN) personality model. It is provided free of charge for personal self-reflection only.
The test page may record anonymous, aggregate usage signals to help us improve the experience. See our Privacy Policy for details.
The test is not a clinical or diagnostic assessment. Results are approximations based on a short self-report questionnaire and should not be used as the basis for medical, psychological, employment, educational, or other consequential decisions. The test does not substitute for professional evaluation by a qualified clinician.
After you complete the test, an 8-character code is generated and shown on the result screen. You can use it in the iOS app to skip the in-app test, or simply ignore it. The code auto-expires after 3 days. Taking the test directly in the app produces identical results, with no functional difference.

Prices may vary by region and currency. The price displayed in the App Store at the time of purchase applies.
All payments are processed by Apple through your App Store account. We do not collect or store your payment information. Payment is charged to your App Store account at confirmation of purchase.
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
You can manage your subscription and turn off auto-renewal in your device's Settings > Apple ID > Subscriptions.
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You retain access to premium features until the end of the period you have paid for.
Refund requests are handled by Apple in accordance with Apple's refund policies. We do not process refunds directly.
We may change subscription prices. Apple will notify you of any price increase before it takes effect, and you will have the opportunity to cancel before the new price applies.
If you live in the UK or EU, consumer law gives you a 14-day right to cancel a subscription from the date of purchase.
By subscribing and accessing premium features, you expressly agree to start the service immediately and acknowledge that you lose this 14-day cancellation right once the service has been provided to you.
This does not affect your statutory rights regarding the quality of digital content under UK and EU consumer law.
Nightmare uses a local-first architecture. Your personal content is encrypted on your device, and we do not maintain user accounts or store your personal content on our servers.
Each week, when your chapter is generated, data from your device is sent through our backend to Anthropic for AI processing. This includes your thoughts (cards), tasks, personality scores, pronouns, recent chapters, current island state, and any connected sources (Apple Health, Calendar, Reminders) you have enabled. This data transits our servers but is not stored on them. Anthropic retains it for up to 30 days (longer if flagged for safety review) and does not use it for AI model training.

You may use Nightmare for personal, non-commercial self-improvement purposes only. You agree not to:
We reserve the right to suspend or terminate your access without notice if you violate these terms or abuse the service.
You retain full ownership of all content you create in the app, including thoughts, tasks, goals, missions, and any other user-generated content.
AI-generated reports are provided for your personal use. You may share them, but you may not sell, sublicense, or use them to create competing products or services.
All intellectual property rights in Nightmare, including but not limited to its code, design, branding, and content, belong to Euphora Labs, TOO. You are granted a limited, personal, non-transferable, non-exclusive, revocable license to use the app in accordance with these terms for the duration of your active subscription.
The app incorporates third-party open-source and licensed components. Applicable licenses are available in the app under Settings > About > Licenses.
To the maximum extent permitted by applicable law, the app is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
You acknowledge that AI output can and will contain mistakes. You are solely responsible for evaluating and acting upon any information provided by the app.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Our total aggregate liability for all claims arising out of or relating to these terms or your use of the app shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) fifty US dollars ($50 USD).

If you are a consumer in the United Kingdom or European Union, your statutory rights under applicable consumer law are not affected.
By You: Cancel your subscription through your Apple ID account settings at any time. Delete the app from your device. Use "Delete All Data" in Settings to erase all local data.
By Us: We may suspend or terminate your access to the app, with or without notice, for violation of these terms, abuse of the service, or for technical, security, or legal reasons.
Effect of Termination: Upon termination, your subscription is cancelled and access to premium features ceases at the end of the current billing period. Your local data remains on your device until you delete it. Anthropic retains processed data for up to 30 days per their data retention policy.

By using the app, you represent and warrant that you are not located in, under the control of, or a national or resident of any restricted territory.
These terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these terms.
If you are a consumer habitually resident in the United Kingdom or European Union, nothing in these terms affects your statutory consumer rights under the laws of your country of residence, and you may bring proceedings in the courts of your country of residence.
Before initiating legal proceedings, you agree to contact us at [email protected] to attempt to resolve any dispute informally.
Severability. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
Entire Agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the app.
No Waiver. Our failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.
Assignment. We may assign or transfer our rights and obligations under these terms without your consent. You may not assign or transfer your rights or obligations without our prior written consent.
